Addresses With Vacancy Rent Control
Some apartments in San Francisco–where previous tenants were evicted under the Ellis Act or for Landlord or Owner Move In–have “vacancy rent control” meaning that the initial rent on these apartments is controlled. Generally, rent of these apartments when vacant can be no greater than the rent the evicted tenant was paying. The time period and specifics of when vacancy control exists differs between the two eviction types and the specifics are listed below.
If you are moving into an apartment (or want to check on the status of you current apartment), check this list to see if your building is on it. If it is, you can find out what is the rent you should be paying at the San Francisco Rent Board and if you are paying too much you can file a petition at the Rent Board to get your rent reduced and and overpayments refunded to you. Following is a searchable pdf file of apartments where tenants were evicted for Landlord or Owner Move In. The landlord can only re-rent the units:
•For 3 years after the date of the eviction notice, evicted tenants must be offered the unit back at the same rent they were paying when evicted and if they are not offered the unit, or refuse it, the initial rent to any tenant moving into the vacant unit must be the same (or less) than the rent the tenant evicted for OMI was paying.
Ellis Eviction Sites
Following are links to files of buildings which have been removed from the rental market pursuant to the state “Ellis Act” (through December 2008). The tenants in these buildings were evicted and pursuant to the Ellis Act the landlord can only re-rent the units in these buildings:
•For 10 years after the date of withdrawal from the rental market (generally 120 days after the date on the eviction notice, or the date on the pdf file linked to) the evicted tenants must be offered the unit back at the same rent they were paying when evicted and for 5 years following the date of withdrawal (if evicted tenants were not offered the unit back or refused it), the initial rent to any tenant moving into the vacant unit must be the same (or less) than the rent the tenant evicted for Ellis was paying.
